This is a written agreement between Something to Remember Wedding Productions & the “Client”. This Agreement is for the sole purpose of booking and reserving a date for wedding photography services and will be used only for that purpose. The retainer paid by “The Client” will be held for wedding photography services to be rendered on the date specified above. The retainer is due at the time the contract is signed. 2. “The Client” understands that if the wedding date stated above is cancelled or changed, Something to Remember reserves the right to cancel this agreement. Any retainer or payments made towards the desired wedding package will be forfeited to Something to Remember. 3. Unless otherwise specified, it is understood that any and all rights to proofs, digital files and finished prints will remain the property of Something to Remember and may be used for advertising, display or any other purpose thought proper by Something to Remember. 4. If Something to Remember cannot perform services in whole or in part due to a fire or other casualty, acts of God or nature, or other cause beyond the control of the parties or due to the Photographer’s illness or injury, then Something to Remember will return all fees to “The Client” but shall have no further liability with respect to this Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault on the part of Something to Remember. “The Client” agrees that an entire wedding cannot be replicated, reenacted or repeated for the purpose of a reshoot and limits Something to Remember liability to the amount paid under this Agreement. 5. A meal must be provided for the Lead Photographer/Videographer and an Assistant (if attending). 6. A person, such as a family member, will be appointed by the bride and/or groom to be in charge of keeping people that are to be photographed in a specified area after the ceremony for group photographs. This is extremely important so the couple can make it to the reception in a timely manner and so all of the desired group shots will be taken. 7. It is understood that Something to Remember is the exclusive photographer/videographer retained to perform photographic services requested on this contract. Others taking photographs will be permitted only at the Lead Photographer’s discretion. 8. If purchasing an album, the design must be approved within 6 months of the wedding date. This includes choosing the photos to include in the album as well as the actual design. If not approved by the “The Client” within the 6 months it will be printed at the Lead Photographer’s discretion. Video Liability: STR will perform production tasks to the best of their ability, but accepts no responsibility for unforeseen circumstances including but not limited to equipment failure, power outages, illnesses, inability to attend and perform services, and/or any other situation where the resulting video product is less than ideal. STR's sole liability in any case shall be limited to a monetary amount no greater than the total of monies paid by the customer. In other words, if a video session either fails to be recorded or is unable to be performed by the fault of STR, The customer will receive a total refund of everything the customer paid to STR for the event. The Clients failure to provide payment in full by the due date as named above may forfeit the reservation of services as well as payment made up to but not to exceed the non-refundable deposit. STR uses DVD-R as a final format that video is distributed with. Some older DVD players, most manufactured before 2000, may have some difficulty playing this format. It is the client's responsibility to make sure this format is acceptable. STR can assist client in this research if needed. Lighting: STR sometimes only uses ambient lighting during wedding ceremonies. Some lighting conditions are not ideal for video and could cause poor video quality. STR is not responsible for any loss of quality due to poor lighting situations. Turn around time: STR strives for quality work, which does take time. Turnaround time of final project may take up to 6 months depending on level of required editing.
